The 4th Panel of the Federal Regional Court of the 6th Region (TRF-6) unanimously decided to restore the benefits granted to former president Jair Bolsonaro (PL), even after his arrest. The collegiate understood that the former president maintains the right to the structure provided for by law for former presidents, including official cars, security guards, drivers and advisors.
The decision was signed on March 13 and was reported by judge Mônica Sifuentes. The appeal was presented by Bolsonaro’s defense after the 8th Civil Court of Belo Horizonte suspended part of the benefits.
A action questioning the concession of the structure was filed by councilor Pedro Rousseff (PT-MG). In a previous preliminary decision, the judge had already reinstated the former president’s security, but maintained the suspension of the use of drivers.
When analyzing the merits, the rapporteur concluded that the drivers not only serve the former president, but also the team that accompanies him. According to her, the withdrawal of this support would compromise the functioning of the group of servers.
“The Union itself, responsible for providing the structure, recognized the inseparability between the team and the means for its transportation”, wrote the judge when justifying the decision. With this, the collegiate determined the full restoration of the benefits provided for former presidents.
