Monique Medeiros was released after a court decision that indicated a possible excess of time with the postponement of the trial
Accused of murder by omission in the death of her son, Henry Borel, Monique Medeiros left Talavera Bruce penitentiaryin the Gericinó Complex, in the west zone of Rio, in the early evening of this Monday (23) and he’s already home.
The release was ordered by judge Elizabeth Machado Louro, of the 2nd Jury Court, after the trial of the Henry Borel case has been postponed. The judge accepted the defense’s request to relax Monique’s prison sentence because, with the postponement, it could incur an excess of time.
In the plenary, before the start of the session, the defense of Jairo dos Santos Júnior, Dr. Jairinho, After the judge rejected the request, the five defense lawyers left the plenary. With this measure, the trial was postponed until May 25th.
According to the judge, the defense’s decision has no legal support and resulted in the undue interruption of the procedural course.
“Fighting the presidency of the act and violating respect for the professional activity of this magistrate in conducting the work, culminating in the abandonment of the plenary session and consequent postponement, is conduct that violates the principles that guide the trial sessions, in addition to the rights of the accused and the victim’s family”, said Elizabeth Louro.
For her, all people involved in the act were violated their right to a trial within a reasonable time.
The 2nd Public Prosecutor’s Office at the 2nd Jury Court of the Capital regrets the illegal conduct of the defense of the defendant Jairo Souza Santos Júnior, known as Jairinho, who left the plenary on the date of the trial, in yet another of the defenses’ repeated attempts to disrupt the regular progress of the process. The MPRJ informs that it will appeal the decision that determined the relaxation of Monique Medeiros’ imprisonment.
Understand the case
Henry died in the apartment where he lived with his mother, Monique Medeiros and stepfather, Dr. Jaririnhoin Barra da Tijuca, southwest zone of Rio. The boy was even taken to a private hospital in Barra da Tijuca, where the couple claimed that the child had suffered a domestic accident.
However, the autopsy report from the Medical-Legal Institute (IML) indicated that Henry suffered 23 violent injuries, including liver laceration and internal bleeding.
Civil Police investigations concluded that Henry was the victim of torture routines practiced by his stepfather and his mother was aware of the attacks.
The defendants were arrested in April 2021 and charged by the Public Ministry of Rio de Janeiro (MPRJ). Jairinho is responsible for qualified homicide and Monique for homicide due to failure to provide assistance.
The complaint points out that on the day of the crime, Jairo Santos Júnior, with free will and consciously, through forceful action against the victim, caused him bodily injuries that were the sole cause of his deathwith the mother, Monique Medeiros, legal guarantor of the victim, omitting her responsibility, effectively contributing to the crime of murder of her son.
According to the MPRJ, on three other occasions, in February 2021, Jairinho subjected Henry Borel to physical and mental suffering using violence.
