Proposal was approved with the favorable vote of 67 senators; there were no votes against or abstentions
The Senate on Tuesday night (March 24, 2026) which includes misogyny in the Racism Law (Law 7,716 of 1989). The proposal, authored by the senator (PDT-MA), now goes to the Chamber of Deputies. The text had the favorable vote of 67 senators. There were no votes against or abstentions from the congressmen present.
The project ofdefines misogyny as conduct that “externalize hatred or aversion to women”. With the new rule, crimes committed based on this prejudice will receive the same legal treatment as crimes of racism, being non-bailable and imprescriptible. All Liberal Party senators voted in favor of the project. Among them, who is a pre-candidate for President. Senators (PL-SP), (PL-ES) and (PL-RN) were not present in the vote.
The president of the Senate, (União Brasil-AP), did not vote because the House’s rules determine that he only votes in specific cases, when there are ties or in secret votes.

According to the Aurélio dictionary, misogyny means the contempt or aversion to women, or the morbid repulsion of men to sexual contact with women.
If the proposal is approved by the Chamber of Deputies and sanctioned by the president (PT), the act of insulting someone by offending their dignity or decorum due to misogyny will be punishable by 2 to 5 years, in addition to a fine. Practicing, inducing or inciting discrimination or prejudice against women will also become a criminal offense, with a penalty of 1 to 3 years.
The penalty will be double for crimes committed against women in the context of domestic and family violence.
The project says that the judge must consider how “Discriminatory is any attitude or treatment given to a person or minority groups that causes embarrassment, humiliation, shame, fear or undue exposure, and that would not usually be given to other groups due to color, ethnicity, religion, national origin or status as a woman”.
