The Public Ministry denounced the former São Paulo councilor Camilo Cristófaro (PSB) as, respectively, former and current Secretary of Public Security of .
Now a federal deputy, Derrite and his successor at SSP, Nico, were targets of criticism from Cristófaro on social media until last year.
In a series of posts, the former councilor insinuated that the pair had committed prevarication in the face of attacks on buses in São Paulo.
“By using fake news (manipulated statistics and fabricated headlines), the accused ensured that the defamation gained a viral scale, making the damage to the objective honor of the victims virtually irreversible”, wrote the Criminal Justice prosecutor, Maurício Salvadori, when indicting the former councilor.
Represented by lawyer Fernando José da Costa, Derrite and Nico also went to the Court of Justice to ask Cristófaro to delete the posts and pay compensation of R$20,000 as moral damages for each.
Judge Camila Franco de Moraes Bariani denied the request for compensation, stating that there was a critical tone on Cristófaro’s part that did not exceed the limits of freedom of expression.
“After all, the posts were made in a social context of insecurity (attacks on buses in São Paulo) which justifies the defendant’s indignation directed at those who perform public functions in the State”, wrote the judge in the decision, dated the 19th of this month.
To the Panel, the former councilor stated that everyone has the right to criticize the lack of security. “I have the right to discuss whether he [Nico] He has the merits to be Secretary of Security for the most important State in Latin America. No one is going to stop me.”
