The Court of Aveiro clarified, this Monday, that the father of the young man accused of killing his mother in Vagos did not oppose the educational protective measure of internment proposed by the Public Ministry.
“The young man’s father did not present evidence or allegations, in which he had expressed his opinion regarding the protective measure proposed by the MP”, says a press release from the Court of Aveiro.
In the note, signed by the presiding judge of the District, Jorge Bispo, it is stated that the MP proposed the application of the educational protective measure of internment to the young man, and the case was therefore advanced to trial, without holding a prior hearing.
Once the trial began, the Court said that it was not possible to apply the aforementioned measure, through the confession of the facts by the young person and his and his parent’s agreement to the same.
“Thus, in the case in question, it was necessary to carry out a trial, with the production of evidence and the rendering of a decision, regardless of the position or positions taken by the young person or parent, regarding the facts and the measure proposed by the MP”, says the statement.
Young man fulfills precautionary measure in educational center
The 14-year-old boy, who is serving a precautionary custody order in a closed educational center, began to be tried behind closed doors at the Family and Minors Court of Aveiro last Wednesdaywithin the scope of an Educational Tutelary Process, initiated by the commission of facts that substantiate a crime of qualified homicide.
The minor is being judged by a group of judges, made up of a career judge and two social judges (citizens, without specific legal training, appointed to assist legal judges in family and juvenile courts).
The next trial session is scheduled for April 10with the examination of the last two witnesses and the production of allegations.
Once the hearing is over, the court gathers to decide, with the decision being taken by majority, with the social judges voting first, in ascending order of age, and, at the end, the presiding judge, who has the casting vote and makes the decision.
The MP requested the application of the educational protective measure of hospitalization in an educational center to the young person, which corresponds to the most serious measure.
Crime occurred in October last year
The victim was found by her husband who alerted the firefighters. Despite the resuscitation maneuvers carried out, death was declared at the scene by the Emergency and Resuscitation Medical Vehicle team.
Less than 24 hours after the crime, the Judicial Police (PJ) announced that it had identified the councilor’s son as the only suspect in his mother’s death.
