Former president Jair Bolsonaro’s defense denied that he had broken the rules of his house arrest after his son, former deputy Eduardo Bolsonaro, stated that he would show the former president a video recorded during his participation in the Conservative Political Action Conference (CPAC), in the United States.
Asked by Moraes, the lawyers representing the former head of the Executive maintained that there is no “objective data” that indicates direct communication with Bolsonaro, nor the use of prohibited means within the scope of the domicile imposed on the former president.
According to the defense, Bolsonaro observes “strictly, fully and permanently” all the conditions set for serving the prison sentence at home, especially the prohibitions regarding the use of communication devices, use of social networks and recording videos or audios.
Moraes had ordered Bolsonaro’s defense to explain Eduardo’s video this morning. In the recording, Eduardo states that he was making the video to show his father.
— Do you know why I’m making this video? Because I’m showing my father and I’m going to prove to everyone in Brazil that you can’t stop unfairly arresting the leader of this movement, Jair Messias Bolsonaro — he said.
To Moraes, the defense maintained that it was unaware of the recording and that it consisted of a “verbal statement from a third party”, without any participation from Bolsonaro.

In the decision authorizing Bolsonaro’s temporary house arrest to recover from bronchopneumonia, Moraes determined that Bolsonaro cannot use a cell phone, telephone or any means of external communication. He is also banned from using social media.
At the end of the 90-day period, the situation will be re-evaluated, including the possibility of a new medical examination, to verify the need to maintain the measure. The home stay must be carried out at the former president’s residence, with the imposition of precautionary measures, including the use of an electronic ankle bracelet.
The minister pointed out that, due to Bolsonaro’s age, his medical history and his health condition, the home environment is more suitable at this time for his recovery.
