The President of the Federal Supreme Court (STF), Edson Fachinstated this Friday (10), that payments to members of the Judiciary and the Public Ministry who disrespect the Court’s decisions on super salaries will be cut.
A declarationhowever, takes place two days after the National Council of Justice (CNJ) – chaired by Fachin to judges and prosecutors, in addition to providing new benefits.
“If there is any issue that goes beyond what the Federal Supreme Court decided, or that is not part of its decision, obviously we will cut it,” said Fachin, when questioned during an event organized by the Human Rights Observatory in Rio de Janeiro about the CNJ resolution.
“We want to bring order to this matter. We are going to bring order to it rationally, with fiscal responsibility and, at the same time, with respect for the judiciary”, stated the president of the Supreme Court.
On March 25th, the STF established a thesis determining the extinction of 15 civil servantsbut allowed the sum of salaries to exceed 70% of the ceiling, equivalent to the salary of a Supreme Court minister (R$46,300). In practice, the Court’s decision allows increasing remuneration to up to R$78,700.
Within the “extrateto”, according to the STF decision, 35% must be allocated to the additional payment for career time and 35% to other compensation funds.
A CNJ resolution, however, created a new obstacle: early childhood protection bonus, which will be 3% of the subsidy per dependent up to six years old. This payment was not on the list of installments authorized by the STF. On the contrary, the Supreme Court ordered the extinction of similar funds, such as “pre-school assistance”, “daycare assistance” and “birth assistance”.
In his vote in the Council, Fachin stated that the text follows “strict compliance with the guidelines set by the Federal Supreme Courtwithout innovating in relation to what was decided.” The resolution was approved unanimously among the 11 councilors who were present at the session.
Until Congress enacts new legislation on the subject, civil servants in general remain bound to the Statutory Regime, within the limits already provided for by law. There is no forecast for voting on a new standard, especially since Brazil is in an election year.
A working group, composed of representatives from the CNJ and the National Council of the Public Ministry, will be responsible for implementing in a coordinated manner the guidelines set by the STF. The objective is to ensure uniformity in the application of rules and strengthen control and transparency mechanisms in the payment of subsidies and benefits.
