What was supposed to be a consensus within the government caused a headache after deputy Rubens Pereira Jr. (PT-MA) presented a project that differed from the Digital Markets PL, presented by the government last year.
The original project foresees the creation of specific rules and obligations for big techs. The idea is that the (Administrative Council for Economic Defense) acts preventively to avoid abuses.
The proposal even creates a structure within Cade itself
The antitrust project is inspired by a law that was approved in 2024 in the United Kingdom.
The PT deputy, however, went in the opposite direction and presented a proposal that conditions tougher measures on Congressional approval. In practice, he proposed more brakes and fewer powers for Cade.
Pereira Jr. also included safeguards such as sectoral impact studies, public consultations and independent auditing before heavier interventions.
The measure generated noise within the allied base itself. At the end of March, the deputy withdrew the proposal. But he told the Panel that he will make adjustments and re-file the text.
Meanwhile, the government’s original project The rapporteur is deputy Aliel Machado (-PR) who has already told deputies that he must present the report by June.
He is already facing lobbying from big companies and must adjust the text. The core of the proposal defended by the government, however, will be maintained.
