The defense of the former presidential advisor filed an embargo for a statement to the (Federal Supreme Court) regarding a decision by the minister that kept him imprisoned in a prison in Ponta Grossa, in the interior of Paraná.
According to the lawyers, “the STF ignored central facts and produced a formally valid decision, but disconnected from the reality of the case.”
The defense’s main argument is that there is a technical document from the Paraná penitentiary authority recognizing a risk to the physical integrity of the former Bolsonaro advisor in staying there and indicating the need for action.
Martins was one of those convicted by the STF for participating in the coup plot. According to the sentence that convicted him, he was one of those responsible for the so-called draft of the coup.
Arrested at the end of last year, the former advisor spent time at the Penal Medical Center, in São José dos Pinhais, in the metropolitan region of Curitiba. The former advisor’s defense claims that the location has better structure and security conditions.
The defense also understands that there is a contradiction from the STF, which in recent decisions recognized that technical information from public authorities is sufficient to support decisions.
Another point of complaint is that the STF ignored the request that a communication be made to the Inter-American Commission on Human Rights, “in light of signs of violation of the integrity of a person in State custody”.
“In summary, the defense maintains that the STF failed to address the real merit of the controversy, ignored relevant technical evidence and was silent on a request of international scope, which could lead to the nullity of the ruling or its review”, says Martins’ defense.
