The Minister of the Federal Supreme Court (STF) Alexandre de Moraes determined last Sunday (19), the postponement for 120 days of the beginning of the execution of the sentence of a lawyer sentenced to 14 years for participating in the undemocratic acts of January 8, 2023.
Aline Morais de Barros performed total hysterectomy surgery to remove the uterus. She had been authorized by Moraes to be without an electronic ankle bracelet only during the procedure.
After the post-operative follow-up, the defense asked for a period of 60 days to replace the device, arguing that the lawyer underwent a “very aggressive procedure” and is “unable to move around”.
The minister accepted the justification and granted a deadline of 120 days. It also determined for the same period the postponement of the beginning of Aline’s criminal execution. The criminal action in which she was convicted became final, a stage in which there are no more appeals left and in which the conviction becomes final, was decreed on April 9th.

The lawyer, who lives in Montes Claros (MG), was sentenced to 14 years for violent abolition of the Democratic Rule of Law, coup d’état, qualified damage and deterioration of listed property.

The sentence includes the payment of a hundred-day fine worth one third of the minimum wage and participation in compensation for collective moral damages of R$30 million, to be paid collectively by others held responsible for the attack on the headquarters of the Three Powers.
Since May 2023, Aline has been on provisional release under precautionary measures involving the use of an ankle bracelet, a ban on leaving the district in which she resides and home confinement at night and on weekends.
Aline was appointed as one of the organizers of caravans to Brasília, with the “declared objective” of “abolition of the Democratic Rule of Law and the deposition of the legitimately constituted government”. In his vote, rapporteur Moraes highlighted that the lawyer was identified in her own publications on social media and in “evidence that attests to her presence in the invaded locations”.
