Defense of Débora do Batom asks the STF to reduce her sentence

Request is based on overturning the veto on Dosimetry; Lawyers also ask for regime progression scheduled for June

Hairdresser Débora Rodrigues dos Santos, known as Débora do Batom, requested the reduction of the sentence of 14 years of imprisonment for involvement in the extremist acts of January 8, 2023. The request was filed by his defense with the minister of this Friday afternoon (May 1, 2026). Here it is (299 KB).

The text bases the justification of the request on the overthrow by the National Congress of the of the president (PT) to the Dosimetry PL. Débora is serving her sentence under house arrest. She is one of the 849 convicts benefiting from the text.

According to the defense, “a legislative change has recently been approved by the National Congress, still pending publication, which introduces relevant changes in the criminal treatment of crimes provided for in articles 359-L and 359-M of the Penal Code”. Lawyers argue that the new rule brings more favorable criteria to the convicted woman.

Lawyers are asking for a lighter sentence, arguing that she was just a participant in the crowd, without having exercised any leadership or financed the events. “This standard establishes criteria that are more favorable to the offender, notably: application of the formal competition and sentence reduction of 1/3 to 2/3 in a crowd context, without leadership or financing”they state in the request.

The defense maintains that the most beneficial criminal law must be retroactive to reach previous facts. Lawyers are calling for the legislative change to be applied in the execution phase of Débora Rodrigues’ sentence.

The order is in advance. The veto has not yet been enacted. The task , (União Brasil-AP). The legislative change awaits official publication.

It will be up to Minister Alexandre de Moraes, responsible for executing the sentences, to interpret and apply the new rule.

The lawyers also requested regime progression for Débora Rodrigues. The defense argues that the hairdresser is close to completing the necessary time for the change to semi-open. Progression is scheduled for June this year.

Débora became nationally known for having written the phrase “You lost, bro” with lipstick on the statue “Justice”located in front of the headquarters of the Federal Supreme Court, in Praça dos Três Poderes, in Brasília.

CLARIFICATIONS TO THE STF

Alexandre de Moraes determined on Wednesday (April 29, 2026) that the on non-compliance with precautionary measures. According to information from the monitoring system passed on to the family, Débora’s electronic ankle bracelet would have registered periods of disconnection between April 20th and 26th.

The lack of continuous signal emission triggered the STF alert and led to the official notification issued by the office of minister Alexandre de Moraes.

On Thursday (April 30, 2026), the hairdresser’s sister, Cláudia Rodrigues, gave an interview to the program “Full Time”from the Pleno.News portal, to deny any irregularity in complying with judicial restrictions.

“I want to make it very clear that there was no non-compliance with these precautionary measures. We are very calm, because Débora has strictly followed all the measures imposed”Cláudia declared to the media outlet.

According to her sister, the hairdresser lives in constant fear of making any unintentional mistake that could be interpreted as a violation of the rules established by the Court.
