The senator and pre-candidate for the Presidency of the Republic, Flávio Bolsonaro (PL-RJ), stated this Sunday, 3rd, that he will work to reduce the age of criminal responsibility to 14 years old in cases of heinous crimes, if elected to the Planalto in 2026.
“I have been talking about some proposals for Brazil, including the reduction of the age of criminal responsibility to 14 years, in cases of heinous crimes, which are the most serious! This type of measure can be approved when the President of the Republic uses his prestige with the National Congress”, he wrote on his profile on X.
Flávio presented, in 2019, a Proposed Amendment to the Constitution (PEC) to reduce the age of criminal responsibility to 14 years for some types of crimes, such as: heinous crimes, torture, drug trafficking, terrorism, criminal organization and criminal association.
According to the senator, the measure will prevent “criminals from using chronological age to commit barbaric crimes”.
The Constitution currently establishes that minors under 18 years of age are not criminally liable and subject to the rules of the Child and Adolescent Statute (ECA).
As the rule is provided for in the Constitution, the change would depend on the approval of the change by the National Congress, with minimum support from three-fifths of parliamentarians in two rounds of voting in the Chamber and the Senate.
