STF reiterates ban on new hangings and prohibits measures that circumvent ceiling

The Federal Supreme Court (STF) published this Friday (8) the decision that prohibits the creation of new pendants e prohibits measures or changes in structure to circumvent the civil service salary cap. The ruling formalizes the Court’s understanding that restricts the payment of extra benefits to members of the judiciary e of the Public Ministry.

The Court’s decision impede that bodies use internal resolutions, administrative decisions or state laws to establish new funds or change the form of current payments with the aim of circumventing prohibitions.

The STF defined that the creation or modification of benefits can only be done through a federal law approved by the National Congress. The text also prevents other public service careers from using the Supreme Court’s decision as a justification for claiming the same payments.

The judgment, , reaffirms that the maximum limit remuneration in the country is R$ 46.366,19an amount equivalent to the salary of the members of the Court itself. The rules establish a restricted list of which compensation amounts can continue to be paid above this ceiling.

The deadline for the parties involved in the processes to present any appeals began with the publication of the ruling in the Electronic Justice Gazette.

The STF guidelines require that the National Council of Justice (CNJ) and the National Council of the Public Ministry (CNMP) must carry out audits on arrears recognized before February 2026. In addition, all courts and Public Prosecutor’s Office bodies are required to publish monthly on the internet o exact amount received by each memberwith details of all installments paid.
