The minister of Federal Supreme Court (STF) Alexandre de Moraes suspended, until this Sunday (10), 24 requests for application of the Dosimetry Law for those convicted of January 8th. Among them is . Moraes claims that it is. The judge gave 5 working days for the Legislature to present a response on the ADI (Direct Action of Unconstitutionality) made by the federation Psol-Rede last Friday (8). In the action, the parties allege that the veto was overturned irregularly, as an entire veto was sliced.
The minister states that the responses from Congress, the Federal Attorney General’s Office and the Attorney General’s Office can influence the execution and even the definition of sentences.
“It may influence the judgment of the requests made by the Defense, recommending the suspension of the application of the law, for legal certainty, until the controversy is defined by the STF, with the regular continuation of the present criminal execution in its exact terms, as has become final and unappealable,” he said.
Lawyers for those convicted began to ask for a reduction in sentences shortly after the promulgation of the Dosimetry law by the president of the Senate, Davi Alcolumbre (União-AP), also on Friday.
The defense of Débora Rodrigues and other convicts released a statement this Saturday (9) stating that Moraes’ decision contradicts the decision of Congress, which approved a law and that this rule is already in force and must be applied.
“The new law itself recognizes that everyone cannot be treated in the same way. Those who organized, financed or led cannot be placed on the same level as those who were merely present in the context of the events. We are discussing the scope of the sovereign will of the National Congress, legal security and respect for the fundamental guarantees provided for in the Constitution”, says the note.
Débora had been imprisoned since 2024 for her involvement in the acts of January 8th. In February 2025, Moraes was granted house arrest following a request from the Attorney General’s Office (PGR) and she has already left the Women’s Resocialization Center in Rio Claro, where she was being held.
The PT/PCdoB/PV federation also filed an ADI asking for Dosimetry to be overturned. The group argues in 76 pages that the law is incompatible with fundamental norms of the Constitution and with the jurisprudence of the STF and asks for a precautionary measure to “suspend the effects of the contested provisions”, “given the exceptional urgency of the case”.
In a statement, the president of the PT, Edinho Silva, called the proposal a “setback against democracy” and recalled the plans to assassinate president Luiz Inácio Lula da Silva (PT) and his vice president, Geraldo Alckmin (PSB), in addition to Alexandre de Moraes.
Understand the approved project
The Dosimetry Bill aims to benefit those convicted of the acts of January 8, 2023 and the former president Jair Bolsonaro (PL). The proposal establishes criteria and defines minimum percentages for serving the sentence and progressing to the regime.
To avoid contradicting the new Anti-Faction Law, before the vote, Alcolumbre considered sections of the dosimetry project on sentence progression to be affected. Therefore, these excerpts were not included in the analysis.
The measure aimed to avoid making sentences more flexible for those convicted in cases, for example, of the formation of a private militia, femicide and heinous crimes.
Despite targeting the rules for calculating sentences and regime progression for those convicted of the 8th of January, the effects of the project could extend to other crimes.
Currently, defendants convicted of both violent abolition of the Democratic Rule of Law and coup d’état have combined sentences. According to the project, the formal competition will be called and only the most serious penalty would be applied, without adding the two convictions. On another front, the text reduces the minimum time for progression from the closed to the semi-open regime.
