STF should judge dosimetry at the end of May, says rapporteur – 05/12/2026 – Politics

The rapporteur of the bill to reduce sentences for those convicted of coup plots, deputy (Solidariedade-SP), met, this Tuesday (12), with the minister of the (Supreme Federal Court) and stated that the court should judge the validity of the so-called Dosimetry Law at the end of this month.

On Saturday (9), Moraes decided, when analyzing requests from prisoners, not to apply the sentence reduction law, which had been enacted the previous day, on the grounds that there are actions that question the constitutionality of the rule pending judgment by the STF plenary.

The expectation among STF ministers and among the Congress leadership is that the court must validate the Dosimetry Law when judging these actions, filed by the PSOL-Rede federation, the PT and the ABI (Brazilian Press Association).

Moraes was selected as the rapporteur for the actions and, therefore, it is up to him to forward them to the plenary for a decision. According to Paulinho, the minister must speed up the case. The deputy, who is close to Moraes, stated that the meeting was positive.

“The immediate effects of the law have been suspended until the STF plenary analyzes the issue. Now, the judge will have a deadline to respond. The response will be until Friday (15) and, then, the PGR will have another 3 days to issue an opinion. Minister Alexandre de Moraes assured me that, as soon as the institutions respond, he will request an agenda at the Supreme Court. The expectation is that the trial will take place in the last week of May”, he published.

“It is important to clarify: the law was not overturned. What happened was a temporary suspension of its effects until the final decision of the plenary. We continue to work for dialogue, justice and the pacification of Brazil”, he also wrote.

The bill was approved by a large majority in December, ended up being vetoed by (PT) and, again, the majority of parliamentarians were in favor of the law. Even so that there is no new conflict with Congress, the opinion among parliamentarians is that the STF will judge the law as constitutional.

In reaction to the suspension of the law by Moraes, the Bolsonaro opposition decided to renew its attack on anti-STF agendas, even though there is no great expectation that the matters will move forward this year.

The offensive has four fronts — the general amnesty for () and other people convicted in the coup plot, including those arrested on the 8th of January; the impeachment of Moraes; pressure from the CPI (Parliamentary Commission of Inquiry) on the PEC (proposed amendment to the Constitution) which restricts the court’s monocratic decisions.

Legislative interlocutors Moraes justified his decision as necessary to seek legal certainty, that is, to not run the risk of prisoners from January 8 being released based on a law that, later on, would be considered unconstitutional.

Moraes was one of the STF ministers on the outlines of the bill, even giving concrete suggestions for drafting the text.
