Municipalities and government disagree on MP for teachers’ minimum wage

Government says that measure guarantees predictability and appreciation for the category; CNM states that the proposal is illegal and has a fiscal impact

The joint commission that analyzes the readjustment of the minimum salary for basic education teachers carried out a this Thursday (May 14, 2026). At the meeting, the CNM (National Confederation of Municipalities) called MP (provisional measure) 1,334 of 2026 illegal. Government officials said that the proposal, scheduled for voting on Tuesday (May 19), will bring predictability and professional development. Here’s the (PDF – 418 kB).

The president’s action (PT) amends the Floor Law and changes the formula for calculating adjustments. The objective is that the index never falls below the variation of the INPC (National Consumer Price Index) and does not exceed the nominal growth of Fundeb (Basic Education Maintenance and Development Fund) revenues.

In summary, with the new formula, the previous year’s INPC is added to 50% of the real variation in Fundeb’s revenue. In January 2026, the change raised the national floor from R$4,867.77 to R$5,130.63 (5.4% adjustment). Under the old rule, it would be 0.37%.

The MP loses its effectiveness on June 1, 2026. If the National Congress does not approve it in the Chamber of Deputies and the Federal Senate by that date, the measure expires. The project is under urgency.

CNM IS AGAINST THE MEASURE

Represented by the CNM stated that a complete review of the agenda was necessary. According to Zilkovsk, the increase in the teaching minimum wage has been 450% since 2006 – compared to 270% of the minimum wage – and consumes 30% of the total payroll of city halls.

The confederation presented amendments to the MP and sent the commission a technical legal note detailing the impossibility of executing the measure.

Zilkovsk called the debate “elector”. He stated that decisions are made to win votes in an election year. On behalf of the entity, he stated that the MP is unconstitutional as it does not indicate a source of funding.

FISCAL PREDICTABILITY

The measure aims to increase predictability in payrolls, according to Gregório Grisa, secretary of Intersectoral Articulation at the MEC (Ministry of Education). As the formula considers the previous 5 years, the government says that entities will have greater clarity when preparing the budget.

According to Grisa, the previous model generated very high adjustments in one year and zero in others, which made it difficult to organize municipal and state accounts.

Defenders of the proposal, senator (PT-PE) and the deputy (PT-MG) stated that it will guarantee professional development. They maintain that the MP avoids zero readjustments and ensures that appreciation is a State policy.

The 2 congressmen declared risks of “blackout” of teachers in the future if there is no real gain in salaries. The MP aims to meet the goal of the PNE (National Education Plan) of equalizing teachers’ salaries to those of other professionals with higher education.

Teresa Leitão responded to the CNM’s criticism of the electoral debate. He stated that Brazil has elections every 2 years and that discussions about public education are “permanent republican commitments”.

OTHER ENTITIES

The FNP (National Front of Mayors) proposed the creation of additional financial aid from the Union for municipalities with lower per capita income.

Consed (National Council of Education Secretaries) requested a change in the date for publishing the adjustment to May. MEC representative, Gregório Grisa said that the ministry chose not to bring forward the announcement so as not to harm teachers with inflation between May and December.

MP APPROVAL

The expectation is that a proposal similar to the one sent by Lula will be approved, according to Rogério Correia. The deputy stated that he will meet with the presidents of the Chamber, (Republicanos-PB), and the Senate, (União Brasil-AP), to speed up the agenda.

The senator (União-TO) has not finished the report and analyzes the amendments. According to the congresswoman’s office: “There may be some changes, but without changing the essence of the MP so that it does not expire”.The presentation is scheduled for Monday (May 18).
