After articulating public defenders, the project can begin to analyze a project that increases the budget allocated to Public Defenders’ Offices in the states. The senator’s project (-GO) establishes a level of 2% of state revenue for agencies.
Today, the law requires the application of resources from the Executive, Legislative and Judiciary branches, in addition to state public prosecutors. The proposal wants to equalize what is passed on to MPs to defenders.
According to Anadep (National Association of Public Defenders), agencies receive, on average, 0.3% of state budgets. There are states that have only one public defender for more than 50 thousand residents — this is the case of Paraná and Santa Catarina.
The president of the association, Fernanda Fernandes, says that the project is a historic milestone for the category.
“Access to free justice has a name and address in the Constitution: Public Defender’s Office. Human rights are not enforced by declarations, but by concrete, continuous and responsible state action,” he said.
The project is still filed in the Senate. In Paraíba, for example, the public defender’s office has a budget of R$109 million, while the state’s Court of Justice has a budget eight times larger: R$895 million.
Now, Anadep is pressing for the president of the House, senator (União-AP) to send the text to the Board of Directors and, with that, forward the project to the thematic committees that will analyze the text.
