History of sanctions
As sanctions against Alexandre de Moraes via the Magnitsky Act were applied for the first time in July 2025still at the beginning of Donald Trump’s second term.
At the time, the State Department and the US Treasury justified the measure citing “serious violations of human rights and fundamental freedoms”including systematic censorship of journalists, influencers and political opponents, in addition to judicial decisions that would have disrespected constitutional guarantees.
Punishments included:
• Blocking of any assets and accounts in the United States;
• Prohibition of entry into the country;
• Restrictions on international financial transactions.
A The measure generated strong international repercussions and was celebrated by the Brazilian conservative camp as a framework of pressure against what they call “judicial activism” and “dictatorship of the Judiciary”. On the other hand, the Lula government and the STF itself reacted vehemently, classifying the sanction as an “unacceptable interference” in national sovereignty.
Em December 2025, sanctions were lifted by the Trump administration in a gesture interpreted as an attempt to detente in bilateral relations between Brazil and the United States. The suspension occurred after intense diplomatic negotiations and pressure from Itamaraty.
Understand the Magnitsky Law
A Global Magnitsky Human Rights Accountability Act é an American legal tool that allows the US government to sanction foreign individuals involved in serious human rights violations, corruption or abuse of power. Penalties range from asset freezes to visa bans. In the case of Moraes, Bolsonaro supporters accuse him of:
• Repeated practices of prior censorship of content on social networks;
• Decisions that would have gone beyond the limits of the Federal Constitution;
• Selective use of judicial power against former president Jair Bolsonaro and his allies.
