Lisbon Forum: Gilmar ignores criticism and targets big techs – 06/01/2026 – Politics

When opening the 14th edition of the Forum, this Monday (1st), he argued that constitutionalism must inaugurate, “in its centuries-old battle against excessive power”, a new front of struggle. The excessive power is now that of big techs, “the new lords of the earth”, which must be combated by digital constitutionalism.

Faced with an institutional crisis in Brazil, the Master case, the American decree considering factions in the country as terrorist organizations and an electoral period that promises to be turbulent, the minister of the (Federal Supreme Court) declared that the Judiciary finds itself faced with the paradox of “acting as a guarantor of institutional instability”, but, in doing so, being “criticized for exaggerating its powers”.

He recalled, however, that the court “is doing its part.” As an example, he cited the assessment of the constitutionality of article 19 of the , last year, and, in the same vein, the recent digital regulation decrees of the Lula government, induced by court decisions.

Criticism of the event itself, which is organized through the IDP (Brazilian Institute of Teaching, Development and Research), an educational institution of which he is a founding partner, did not deserve the attention of the Dean of the Supreme Court. “I have the impression that every year the event becomes more consolidated. This has become a seal of guarantee, of quality, of good discussions”, Gilmar told journalists, after the opening event, with “more than 2,000 registered”.

Unofficial counts from Gilmarpalooza, the derogatory nickname for the event, however show a drop in the number of registrants in the current edition compared to last year. The turnout of the Brazilian political and legal elite also appears visibly smaller, with the presence of only one of Gilmar’s colleagues, the minister, who was accompanied by his wife. , who was going to come, suffered a domestic accident and canceled his participation.

There was also a significant drop in the number of State ministers (3) and governors (1).

The exception was the “bench of the (Superior Court of Justice)”, as defined by minister Luis Felipe Salomão, vice-president of the court and also representative of FGV, another organizer of the event. In his first explanation, in the auditorium of the rectory of the University of Lisbon, Salomão went so far as to say that he would speak the names of the various colleagues present “in alphabetical order”. According to the organization, 450 debaters from Brazil and 15 other countries will be in action, including journalist Thomas Friedman and Nobel laureate in Economics Joel Mokyr, who will have to overcome Lisbon’s heat of 25°C this Monday, but which reached almost 30°C over the weekend.

Another obstacle for Gilmar and guests will be a general services strike, scheduled for Wednesday (3), the last day of the forum, which is expected to affect public transport and the airport in the Portuguese capital. Airlines are already warning customers about the problem.
