Jury sentences Jairinho to 43 years in prison in Henry Borel case

The boy’s mother, Monique Medeiros, was pardoned and will leave prison; Henry died in 2021

Former São Paulo councilor Jairo Souza Santos Júnior, known as Dr. Jairinho, was sentenced in the early hours of this Thursday (June 4, 2026) to 43 years, 9 months and 20 days in prison for the death of his stepson, Henry Borel. The boy died in March 2021, aged 4.

The child’s mother, Monique Medeiros, was convicted of omission in the face of the torture inflicted on her son. The sentence imposed was 1 year and 4 months in prison, but it was considered served. Judge Elizabeth Machado Louro, from the 2nd Jury Court in Rio, granted a judicial pardon to Monique, who will leave prison.

The judge decided that Jairinho must pay R$400,000 for moral damages to the child’s father, Leniel Borel.

Louro, when defining Jairinho’s sentence, mentioned Henry’s vulnerability. He said the boy was subjected to physical and psychological suffering. In Monique’s case, the judge declared that she had no criminal record and was the target of disproportionate social charges.

According to the Public Ministry’s indictment, in the early hours of March 8, 2021, the child’s then stepfather attacked the boy, causing the injuries that led to his death. Dr. Jairinho was tried for murder with aggravating circumstances, such as the use of cruel methods and the fact that the victim had no chance of defense. He was also responsible for 3 cases of torture and for trying to pressure witnesses during the investigation.

The jurors accepted the prosecution’s thesis. Jairinho was convicted of murder, 1 case of torture and coercion during the process. He was acquitted of the remaining charges.

The MP and Jairinho’s defense said they will appeal the decision.

To the newspaper Folha de S.PauloRodrigo Faucz, one of the defenders responsible for the case, stated that the jury was marked by “a series of nullities”. He declared that the jurors’ decision did not reflect the evidence produced in the case file.

Lawyer Fabiano Lopes classified the session that resulted in the conviction as “beard”. According to him, there was unequal treatment between Jairinho and Monique’s defenses. Lopes stated that Jairinho’s defense was prevented from fully operating.
