Former Rio de Janeiro councilor Jairo Souza Santos Júnior, known as doctor Jairinhowas sentenced this Thursday (4) to 43 years, 9 months and 20 days in prison for the death of boy Henry Borel. He was found guilty of double homicide and torture committed against the boy Henry, who had 4 years at the time of the crimes.

The child’s mother, Monique Medeiros da Costa e Silva, was charged with intentional homicide (when there is intent to kill) disqualified by the Sentencing Council of the 2nd jury court of Rio de Janeiro, and converted into guilty, considering it was unintentional. She was convicted of torture by omission and sentenced to 1 year and 4 months in detention, but, as she has already served time in preventive detention, the sentence was considered ended.

In addition to prison, under an initially closed regime, Jairinho will have to pay a compensation of 400 thousand reais to the victim’s fatherLeniel Borel. The conviction for qualified homicide was aggravated by kinda cruelan appeal that made the defense impossible and resulted in an increased sentence due to Henry being under 14 years old, in addition to torture and coercion during the process.

When reading the sentence, judge Elizabeth Machado Louro highlighted the “disproportionate violence” and the “rare and disproportionate cowardice” against the child, described as sweet and kind. The judge stated that the convict has a “insidious personality“, capable of simulating kindness to hide a truculent and extremely dangerous nature.

The trial, which lasted 11 days, was the longest in the history of the Rio de Janeiro Court of Justice. It began on May 25 and included testimonies from the defendants, medical experts, witnesses and family members, and was interrupted only for meals, physiological needs and the overnight stay of the seven jurors who form the Sentencing Council.
