The dispute for command of the state did not end. Despite having received 160,004 votes, equivalent to 60.87% of valid votes, the candidate had his candidacy suspended by decision of the Federal Supreme Court (STF) and still depends on a definitive judgment to be declared elected.
Given the legal uncertainty, the state government will continue under interim command of the president of the Legislative Assembly of Roraima, deputy Soldado Sampaio (Republicans).
His permanence in office was confirmed by the Regional Electoral Court of Roraima (TRE-RR), which informed that the official proclamation of the result will depend on the conclusion of the processes being processed in court.
The situation was created after a decision by Minister Flávio Dino, from the STF, given on Friday (19), two days before the vote. The judge understood that candidates for the supplementary election should observe the original period of disqualification provided for by electoral legislation and the jurisprudence of the Superior Electoral Court (TSE), equivalent to six months before the election.
Arthur Henrique left Boa Vista City Hall within the deadline previously established by TRE-RR, which had relaxed the rule for the extraordinary dispute. Based on this understanding, the campaign maintains that it complied with all legal requirements and filed an appeal to reverse the Supreme Court’s decision.
The impasse did not prevent the former mayor’s name from remaining on the ballot. Therefore, the votes received by Arthur Henrique were counted normally, but remain subject to judicial validation.
In a statement released on Sunday night, TRE-RR defined that the definitive proclamation of the election result will depend on the conclusion of the trial.
Pending the decision, the position will be occupied on an interim basis by the president of the Legislative Assembly of Roraima, deputy Soldado Sampaio (Republicans).
The deputy even contested the election against Henrique, but ended up coming in second place with 897 votes, totaling 35.72%.

Understand the conflict between the STF and the TRE-RR
The STF’s decision, which followed the understanding of rapporteur Flávio Dino, revoked a resolution from the Regional Electoral Court of Roraima, which changed the non-compatibilization rules so that candidates could abdicate their public positions within 24 hours after the announcement of the date of the supplementary election, which only took place in May this year, less than a month before the vote.
When justifying the revoked measure, Dino stated that the non-compliance deadlines are not a mere formality, but mechanisms designed to preserve equality between the candidates and the legitimacy of the electoral dispute.
As a result, the official deadline for Henrique to be able to run would be his disqualification six months before the vote, that is, he would have left the position of mayor in January of this year, a time when it was not known that there would be a new dispute for the position of governor in the state.

The former mayor’s defense claimed that, in practice, Dino’s decision would make it impossible for any candidates holding public positions to participate.
In addition to filing an appeal with the STF, the candidate also took the case to the Superior Electoral Court, requesting that the Court revalidate the TRE-RR’s understanding.
