AGU sues Federal Police and CVM for fake news about Galípolo’s speeches

The (AGU) sent letters to the Securities and Exchange Commission (CVM) asking that “police and administrative procedures” be instituted, respectively, to investigate fake news published on social networks with false statements by the director of Monetary Policy and future president of the Bank Central, . In a note, the AGU informs that the request concerns “possible crimes against the capital market resulting from the dissemination of disinformation on social media”.

The National Prosecutor’s Office of the Union for the Defense of Democracy (PNDD) was contacted by the Social Communication Secretariat of the Presidency of the Republic (Secom), after posts on X – formerly Twitter – attributed false statements to Galípolo. “The posts bring positions that are devoid of any basis, promptly denied by the Central Bank, but which gained significant repercussion in the financial market and on pages and profiles specialized in economic analysis, a fact that generated negative impacts on the dollar exchange rate”, highlighted the AGU. For the government, disinformation, “by directly interfering with market perception”, compromised the effectiveness of the federal public exchange stabilization policy, highlighting the high harmful potential of rumors in this context. ”

It is known that there is a direct relationship between the price of foreign currency, notably the dollar, and the prices of securities traded on stock exchanges, so much so that the recent increase in the value of the American currency was accompanied by a fall in the amount of securities traded on the capital market”, completes the document. According to the AGU, fraudulent conduct can constitute a crime against the capital market (market manipulation), as established in art. 27-C of Law No. 6,385/1976, which regulates the securities market.
