Procon-SP Fine Nestlé at R $ 13 Mi for misleading advertising

According to consumer protection agency, product names did not match their revenue; company can resort

Procon-SP (Consumer Protection and Protection Foundation of São Paulo) charged Nestlé on Wednesday (23.br.2025), applying a fine of approximately R $ 13 million for misleading advertising in product packaging.

The inspection revealed that the company sold products with ingredient names that were not used in recipes, such as nesfit cookies in oat and honey, milk and honey flavors and cocoa cookie, oats and honey.

Nestlé Cream Cream was also considered misleading by inducing the consumer to error. The product is a mixture of UHT (Ultra High Temperature) of sour cream and whey.

Nestlé has the option to resort to the fine defined by Procon-SP. In a statement, the company said it will present its defense and that the products are no longer marketed.

Nesfit Oat and Honey, Nesfit Leite and Mel and Nesfit Cookie Cocoa, Oat and Mel cookies are no longer part of the company’s portfolio, having been discontinued by 2022. The same is true of the mixture of sour cream, which has not been sold by the company since 2023“The note said.
