The third day of the trial of the coup plot by the (Supreme Court), on Tuesday (9), was full of irony and analogies made by E. Sometimes the votes were interrupted by games between the two ministers.
They made use of comparisons and different references throughout the manifestations given to condemn (PL) and seven other defendants of the central core of the case. The demonstrations were considered harsh and there was no vote for the acquittal of any of those involved.
In the foundation of positions, Moraes made comparisons of Bolsonaro’s conduct with the mafia, and Dino referenced the character Mickey by addressing the sanctions of US President Donald Trump to the court members.
The rapporteur of the case compared the former president to a mafia boss for leaving the country when his supporters attacked the headquarters of the powers on January 8, 2023. According to the minister, that does not depart from Bolsonaro from the leadership of the movement.
“What is the best disguise for a criminal organization leader to make the coup, which he couldn’t get throughout this time, than travel abroad? ‘I wasn’t there,'” Moraes said. “Obviously, when the mafia soldier commits a crime at the behest of the mafia cap, he is not there, the head of the criminal organization. But he responds because he determined,” he said.
Reading the notes of Alexandre Ramagem, former director of ABIN (Brazilian Intelligence Agency) under Bolsonaro, with attacks on the electronic ballot box and sent to the former president, the comparison was with Brazilian organized crime: “This is not a message from one CCP delinquent to another, it is a message from ABIN director for the then president.”
Moraes chose to present his vote chronologically, to reinforce the existence of a criminal organization that acted for the maintenance of Bolsonaro in power, and even cited defendants of coup plot nuclei whose judgments have not yet been carried out.
At one moment, he said it was not believable that General Mario Fernandes would have made a “role boat” with the impression of the green and yellow dagger plan, which predicted murders of authorities.
According to investigations, Fernandes printed the planning of the murders on November 9, 2022 at the Planalto Palace. About 40 minutes later he would have gone to Alvorada’s palace, the official residence of the presidency then occupied by Bolsonaro.
“It is not believable, it is not reasonable that Mario Fernandes printed and headed for the palace of Alvorada, where there was the president, was 1h06 and made paper boat with the impression. That is to ridicule the intelligence of the court,” he said.
Moraes also played the mentions to him and other ministers made by Jair Bolsonaro at the ministerial meeting of 2022.
When reading Bolsonaro’s quote about the ministers at the time – “this citizen who is here is a Marxist, MST lawyer” – Moraes makes the caveat: “It’s not me, Minister Flávio [Dino]the reference here is the minister [Edson] Fachin “.
He continues to reproduce Bolsonaro’s lines: “Alexandre de Moraes you know what its previous life is,” reads Moraes, gesturing doubt.
The minister also says that “asked in judicial interrogation, in the 42nd question that this magistrate asked after the lawyers asked 14 questions, apologized, said it was his way, that had no evidence.” The mention of the number of questions is also a joke about the defense of General Augusto Heleno, who called him “inquisitor judge.”
Already Flávio Dino, when voting, stressed that the intention of those involved in the attempted coup after Bolsonaro’s electoral defeat was not a pacifist.
As an example, he used the name of the plan involving the death of authorities. “The name of the plan was not green and yellow Bible, it was green and yellow dagger,” he said.
The minister also recalled the demonstration of September 7, 2021, in which Bolsonaro threatened the Supreme Court, and asked if he had indeed slept in court, as commented.
“Minister Fux, despite our great personal relationship, I never asked if the narrative proceeds that you slept that night in the presidency,” said Dino.
“I attended the court because I had 150,000 people in the three powers’ square and nothing happened,” Fux replied, president of the court at the time. “With the grace of God,” Dino amended.
The trial had its moment of greatest tension when Luiz Fux complained of a demonstration of Dino during the vote of Moraes.
“As we talked to that room here, the ministers would vote straight without intervention by other colleagues, although this intervention of Minister Flávio Dino was proper. But I would like to fulfill what we agreed when I vote,” said Fux.
Dino commented on the fact that monocratic decisions in the courts passed by the referendum of the plenary. The president of the first class, Cristiano Zanin, said that, in this case, Moraes had granted the apart to Dino. Fux replied, “But I won’t grant it.”
Finally, Dino countered: “I reassure him, Minister Fux, because I will not ask you from your excellence, can sleep in peace.”
In response to Trump’s attacks on Brazil and the ministers, Dino also let out: “I am amazing to imagine that someone comes to the Supreme and will be intimidated by Tuitis. Will people believe that a tweet of an authority, a foreign government, will change the Supreme Court? Will anyone imagine that a credit card or Mickey will change judgment?”.
