The judgment of the defendants of Nucleus 1 in the Supreme Court (STF) won a new chapter with the demonstration of Minister Luiz Fux, who signaled a possible divergence during the session. During the session, Fux made a point of mentioning a prior agreement established among the ministers behind the scenes, stating that there had been no interruptions. His posture indicated a probable respectful divergence, different from what was observed in previous judgments, such as the monthly.
Preliminary questions in focus
A prominent point was when Fux expressed interest in returning to the preliminary issues of the process. Minister Alexandre de Moraes argued that these issues had already been voted and approved, but Fux countered, stating that the current moment of the trial would be different from the previous one.
The preliminaries in question involve two main defense requests: one related to defense curtailment, alleging lack of access to all evidence, and another referring to Lieutenant Colonel Mauro Cid’s denunciation. Although these issues usually precede the discussion of evidence, the court opted for a joint analysis with the merit.
According to experts, although there are disagreements, the possibilities of appeals after judgment are limited. The Supreme Court maintains a restricted understanding of funds in criminal proceedings since 2018, allowing embargoes infringing only in cases with at least two votes for acquittal.
