Since August 2025, the amendment to the Building Act has significantly changed the conditions for small buildings. Many of them do not need to be announced or approved. Yet there are exceptions that are good to know.

Are you tempted to build a greenhouse or a small pool in the garden? Since August this year, the law will make it much easier. The amendment to the Building Act enters into force, which expands the list of small buildings for which no building permit or approval no longer requires. Newly, you can build a number of smaller buildings without unnecessary bureaucracy, but it is still necessary to maintain certain conditions, especially in size and location.

What can you build without permission

Small buildings have clear limits according to the law. If you follow them, you can do without running around the authorities. Without a building permit, pergolas, greenhouses or swimming pools can be built from August if they do not exceed the built -up area of ​​40 m² and a height of 5 meters. Construction must be located at least 2 meters from the boundary of the land and must not be intended for housing, recreation or business.

Newly, it is no longer a condition for small buildings to stand on a built -up building plot. So you can also build them in the garden of a family house or in a garden colony if at least 50 % of the area for infiltration of rainwater is maintained.

Even for small buildings, it is necessary to be careful whether the land is not in a monument protected area or in the protection zone. In such cases, further restrictions may apply and the construction should be consulted with the competent authority.

Not all buildings fit into the category of “small”. In some cases, you can not do without permission.

Another good news is that for most simple buildings, a project from an authorized designer will no longer be needed. The documentation prepared by an expert with a corresponding education is sufficient. The approval will only apply only to buildings for housing and family recreation.
