The bodies of the European Union (EU) and international organizations and institutions have no right to decide on Slovak cultural and ethical issues. In response to the opinion of the Venetian Commission on the government’s draft amendment to the Constitution of the Slovak Republic, this was stated by the Ministry of Justice. He thinks Only the Slovak Parliament has the right to decide on the national identity and superiority of the Constitution. TASR informed the head of the press department of the Ministry of Justice (MS) of the Slovak Republic Petar Lazarov.
“As for the anchoring of national identity and superiority of the Constitution, We are convinced that only the Slovak Parliament has the right to decide on these sensitive issues, And in terms of the right to self -determination and democracy, ”said Lazarov. According to him, the Constitution guarantees sovereignty of the Slovak Republic and there was no transfer of competences in cultural and ethical issues on the European Union or other bodies. He added that the interpretation of the term national identity will be in the hands of the Constitutional Court of the Slovak Republic in the constitutional dialogue with the EU Court of Justice, not arbitrary.
The Ministry of Justice appreciated that In its report, the Venice Commission positively evaluated open communication with Slovakia. “At the same time, we also positively evaluate the content of the opinion. The Venetian Commission indicates the need for a broader social debate. Here we have to say that we are constantly conducting many consultations with representatives of the European Commission and various international organizations, proving the efforts for the greatest possible transparency,” Lazarov said.
Re -reminded that The draft amendment to the Constitution has undergone a standard legislative process and has the support not only of the government coalition, but also parts of the opposition. The resort also argues a public opinion from September 2025, according to which the proposal of constitutional changes is based on a wide support of the population.
The World Championship positively evaluates that the Commission has acknowledged the prohibition of alternative motherhood and that it also welcomes the provision of the same remuneration of men and women, which it considers to be consistent with the obligations of the Slovak Republic. It also agrees to the Commission’s finding that the restriction of adoption to marriage couples does not in itself constitute a violation of the European Convention for the Protection of Human Rights and Fundamental Freedoms. “As stated by Slovak legislation, the only guide principle in deciding on adoption must be the best interest of the child,” He said Lazarus.
It also defends the anchoring of recognition only by the biologically determined sex of man and woman. It argues that such an understanding is in accordance with the practice of several European countries and that the Slovak law is already prohibiting discrimination on the basis of gender, genus or sexual orientation.
The Venetian Commission warned on Wednesday that In the government draft amendment to the Constitution of the Slovak Republic, which the National Council of the Slovak Republic is to vote on Thursday (25 September), there are unclear and general formulations that pose a risk of arbitrary interpretation and application. It addressed four recommendations to Slovakia to avoid the risk. Among other things, it is intended to refine terms such as “national identity” and “cultural-ethical issues” and to determine the law that decisions on the adoption of the child are exclusively governed by his best interests and the principle of discrimination.
