Arrested in Italy, the Federal Deputy (-SP) was heard, on Wednesday (24), by the CCJ (Committee on Constitution and Justice and Citizenship) of the House, where he was persecuted by the STF Minister (Supreme Court), whom he called the bandit.
“When did I realize this persecution? That’s when they started these extreme measures, […] They told me to apologize on Facebook. This interview was deleted from [programa] Panic, this video in which I say that he [Moraes] He was a lawyer for the vans of the CCP. There I realized I was dealing with a person who was a thug, “he said.
Moraes has already represented as a lawyer, legally, a cooperative of vans from São Paulo that was later investigated for alleged connection with the CCP.
Zambelli deposed remotely by video call and wore a gray sweatshirt. “In a short time, I won’t be in prison anymore, because the process was all unfair,” she said.
“This arrest happened so that I could expose to Italy my confidence in justice here, until I could explain to me of what is happening in Brazil,” he said.
The (Federal Supreme Court) to the loss of mandate and ten years in prison for invading the CNJ (National Council of Justice) system with helping hacker Walter Delgatti Neto, who was also convicted.
The hacker issued a fake arrest order against Moraes and said he had done this at the deputy’s request. Zambelli replied that he did not help write the false order of arrest, as the accusation points out, and that he learned of the CNJ invasion of Delgatti only after the facts. The document was found on its devices.
“He [Delgatti] must have sent me after having done it. I think he sent me because I was interested in virtual security. I even got a little scared because this kind of situation could harm me in some way and there I gave a distance from him, “he said.
In his speech, Zambelli explained his relationship with Delgatti, denying that there was proximity or that the hacker had stayed in his functional apartment ,. According to the deputy, her goal was to investigate whether it was possible to defraud electronic ballot boxes, as she defends the agenda of the vote printed for years.
Zambelli reported undergoing financial difficulty for having his salary and kitty of Moraes blocked supporters, and her husband also had blocked accounts and her son had the hanging nets. “He gets to the point of not being able to hold on, he wanted to reach all my family.”
Asked about having some regret, the deputy said she regret the episode in which she pursued a man with the gun in hand, on the eve of the 2022 election, especially after hearing that the former president (PL) attributed his defeat to this, assessment she disagrees.
Deputy Fernanda Melchionna (PSOL-RS) questioned the decision to take the deputy, whom she called the fugitive and bandit, without the consent of diplomacy or Brazilian organs responsible for the relationship with Italy. The president of the CCJ, Paulo Azi (União Brasil-BA), said that it was based on the right to broad defense and contradictory.
Zambelli and Delgatti were convicted in the Supreme Court for the crimes of invasion of computer device and ideological falsehood.
The mayor, (Republicans-PB), had initially said that the chamber table would approve the order of revocation immediately, but and sent the case for analysis of the CCJ.
The deputy fled from the country, passing through Argentina and the United States before landing in Italy. After about two months on the run, and waits, detained in a prison in Rome, the decision on its extradition process for Brazil.
The deputy’s testimony ends the instructional phase and, from this Wednesday, the rapporteur, Deputy Diego Garcia (-PR), has five sessions to present his opinion. Upon voting on the case by the CCJ, the removal of the mandate will be decided by the House Plenary – a major majority of 257 votes for the revocation.
Before Zambelli, three witnesses nominated by the defendant’s defense: Delgatti; Michel Spiero, Defense Technical Assistant and Digital Evidence Specialist; and Eduardo Tagliaferro, former advisor to Moraes. Not all, however, agreed to give testimony.
According to the complaint of the (Attorney General’s Office), Zambelli planned and commanded with Delgatti an invasion of the council’s institutional systems in order to issue false release permits and cause confusion in the judiciary.
Cassation divides the very bench of the PL. While some deputies believe that Garcia’s report will be unpaid and that there will be votes to save her, others claim that Zambelli will not be able to exercise the mandate of Italy.
