PSOE and Sumar agree on the text to protect the right to abortion in the Constitution | Spain

This Tuesday after the Council of Ministers, the Government presents its proposal for drafting the . After days of negotiations and exchange of proposals that lasted all night between the partners, the formula finally adopted contemplates a new section in article 43 of the Constitution, number four. Its final draft, which has been the subject of an intense debate between PSOE and Sumar, will be announced at a press conference by the ministers of Justice, Health and Equality (Félix Bolaños, Mónica García and Ana Redondo). In the last hours, the group of Vice President Yolanda Díaz had denounced that the initial proposal of the socialists was insufficient and could represent “a setback” by opening itself to a change in the assumptions.

The ideological battle with the right, which has stirred up the debate on the right to abortion in recent weeks, has led President Pedro Sánchez to take the initiative for the Fundamental Law. But Sumar, who proposed doing so in 2024 and in February of this year presented his initiative, denounced that the socialists’ approach referred to what the legislation itself dictated, which opened the possibility that if this was modified in the future, the right would also be altered. Always according to Sumar, the formula originally proposed was the following: “4. The right of women to voluntary interruption of pregnancy is recognized. The law will regulate the exercise of this right, which, in any case, will be guaranteed by the public powers, ensuring its provision under conditions of equality.”

Finally, in the last few hours the text has been unblocked and there is agreement, according to government sources, although Sumar aspires to continue dialogue. “The negotiations go through various texts. Without being able to reveal anything, I do tell you that we have managed to move forward,” celebrated the group’s parliamentary spokesperson, Verónica Barbero, with the Council of Ministers already underway. The deputy added that the reform must meet the expectations of all civil society. “We do hope that the text is sufficient for a first round and to continue negotiating,” he added.

This Tuesday, Sánchez announced in an interview on Cadena SER that today the Council of Ministers will approve the registry of conscientious objectors that President Isabel Díaz Ayuso has refused and also that he will begin the procedures for the constitutional modification by requesting a first report from the Council of State.

Last February, Sumar proposed protecting the right to abortion with the following wording, adding a new point to article 43: “4. The right to a voluntary interruption of pregnancy that is free, informed, full and universal is recognized. The public authorities will guarantee the exercise of this right with absolute respect for their physical autonomy.”
