According to the MP’s complaint obtained by the column, the events would have occurred on August 9, 2025, at Fabiano’s residence, located in the Mangueiral Housing Sector, in Brasília. The Public Prosecutor’s Office reports that the advisor, voluntarily and consciously, taking advantage of domestic relations, allegedly attacked his ex-partner during an argument, while she was preparing her bags to leave the place.
A forensic examination report attached to the case indicates the existence of bodily injuries such as bruises and redness on different parts of the body.
The Public Prosecutor’s Office charged Fabiano based on the Penal Code and the Maria da Penha Law, legislation that defines situations of domestic and family violence against women and establishes urgent protective measures for victims.
The MP also requested the establishment of minimum compensation for moral damages, in line with the understanding of the Superior Court of Justice (STJ), which authorizes automatic compensation in cases of domestic violence when there is an express request from the Public Prosecutor’s Office.
Also according to the prosecutor’s office, investigations into other crimes, such as rape and psychological violence, were shelved due to a lack of technical evidence and the absence of a conclusive expert report. The MPDFT also informed that there is no proposal for a conditional suspension of the process, following precedents from the STF and the STJ.
The case is being processed in the 1st Court of Domestic and Family Violence against Women in Brasília, under judicial secrecy. The complaint was signed by prosecutor Ramona Anchieta Mendel, from the 1st Public Prosecutor’s Office for the Defense of Women.
Defense version
After contacting the column, lawyer José Alexandre Pirôpo Marques sent the following note, signed by Camila Wilerson Barbosa da Silva, responsible for the defense of Fabiano Rocha Guimarães:
“Dear journalist,
In respect for your contact and the right to information, Fabiano Rocha Guimarães’ defense clarifies:
The complaint mentioned by the Public Prosecutor’s Office arises from a troubled relationship ending, the context of which is significantly broader and more complex than that initially presented.
It is important to highlight that Mr. Fabiano also appears as a victim in investigative procedures, having registered police reports against you for crimes such as stalking and slanderous accusations, the evidence of which has already been presented to the competent authorities.
It should be noted that, in the same investigation that generated the complaint, initial more serious charges were filed at the request of the Public Prosecutor’s Office itself, due to lack of evidence, highlighting the fragility of the accusatory narrative.”
The column also tried to contact the government leadership in the Chamber. The space remains open.
