ANP partially releases facilities at the Manguinhos refinery

Agency understood that Refit presented corrections for 10 of 11 conditions indicated; distillation tower remains closed

A (National Petroleum, Natural Gas and Biofuels Agency) decided, this Saturday (25.Oct.2025), to partially release the operations of the (Manguinhos Refinery). The company has proven compliance with 10 two 11 conditions identified in an inspection carried out on September 25th and 26th.

The measure is a 1st step towards resuming part of your processes. Refit is authorized to formulate fuels, move and sell its products and inputs (as well as those of third parties stored in its facilities), as long as applicable regulatory standards are respected.

However, the restrictions on the distillation tower “until the need to use the columns to compose gasoline production is proven”.

According to the technical analysis of the documents presented, the need to use distillation towers for the production of gasoline, based on the declared imported inputs, has not yet been justified.”said the ANP.

O (Instituto Combustível Legal) stated that the partial release causes concern because of the “non-fulfillment” ANP requirements. According to ICL, the measure “raises an alert about the regulatory, tax and security risks associated with the resumption of the company’s operations”.

“The decision highlights a serious asymmetry in the regulatory treatment of the sector: the activity of fuel formulation is currently prohibited for new companies, precisely due to the history of irregularities and fraud involving former formulators, but, even so, the ANP authorized Refit to formulate fuels”says the institute.

UNDERSTAND THE CASE

On September 26, the ANP precautionary measure at all Refit facilities, based on an inspection operation that revealed signs of irregularities in the import, movement and production of fuels.

According to the agency, they found “imports of practically ready-made fuels”with possible alteration of the classification to reduce tax burden, unauthorized storage tanks and absence of signs of effective refining.

A Refit the ban, stating that the legal requirements for a total shutdown were not met and that there was no imminent risk to the consumer, the environment or public property.
