The debate about the reform of Austrian sexual criminal law and the anchoring of the principle “Only yes means yes” has once again become the focus of the media. In this discussion, however, it is also essential to legally differentiate between the facts and not to lump everything together. Given the fact that sexualized violence remains alarmingly widespread in Austria, the question of why the difference is so crucial for those affected arises with corresponding urgency. Modern sexual criminal law should consistently protect the sexual self-determination and integrity of all people.
