Martins rebuts PF delegate about alleged trip to the USA – 11/06/2025 – Panel

Defendant in the STF coup plot case, the former presidential advisor accuses Fábio Shor’s delegate of using the investigation into the case as an “instrument of personal defense in the face of investigative errors already exposed internationally”.

In a statement sent to Minister Alexandre de Moraes, of the Federal Supreme Court, lawyers Ricardo Scheiffer Fernandes and Jeffrey Chiquini, from Martins,

According to defenders, Shor’s letter “is not a technical report, but an attempt to rewrite history to justify the illegal and abusive arrest of an innocent person.”

Martins was imprisoned for six months last year on Moraes’ orders following Shor’s investigation. The main justification was the risk of flight, due to the fact that the former advisor allegedly left Brazil with the former president for the USA at the end of 2022.

Martins, however, presented several elements that he never left the country, including plane tickets, Uber receipts and cell phone geolocation data.

On October 10, he also scored a victory after a report showing his supposed entry into Florida at the end of 2022 was rigged.

Shor, on the other hand, stated that Martins had induced American authorities to claim that he entered the country, which is refuted by the former advisor’s lawyers.

According to the pair of defenders, there is an “attempt to reverse the logic of the investigation, by suggesting that Filipe Martins had ‘misled’ the authorities, staging a non-existent trip to ‘demoralize the PF'”. The hypothesis is defined as a “delusional and legally impossible fantasy”.

In the statement to Moraes, the defense attaches the CBP note and audit of the American immigration system that says that Martins never entered on the date alleged by the Federal Police.

Notary records of all pages of the former advisor’s two passports (diplomatic and common) were also attached, drawn up at a notary’s office, which attest to the lack of record of his international exit or entry on December 30, 2022.

The defense also refutes criticisms made by the delegate against people who were helping to spread Martins’ version on social networks.

According to the lawyers, Shor is trying to censor the debate with an “unprecedented and authoritarian proposal to open a new inquiry to investigate lawyers, journalists, influencers and citizens who publicly questioned the delegate’s conduct, in flagrant violation of freedom of expression and the prerogatives of the legal profession.”

In the coup plot trial, Martins is accused of having helped prepare the so-called “coup draft”, which he denies.

The defense also requested that the information gathered be sent to the Federal Police’s internal affairs department, to investigate Shor’s conduct.
