
The Investigative Court number 15 of Valencia has once again rejected the opening of an oral trial against the former vice president of the Consell and ex-counselor of Equality during the period of the Botànic Government, Mónica Oltra, for the cause of the alleged cover-up of sexual abuse of a warded minor
In an order dated December 18 to which EL PAÍS has had access, the judge dismisses the reform appeals filed by the popular accusations brought by Gobierna-te and Vox against the previous resolution of June 2025 in which she opened against Oltra and several of her former collaborators.
The instructor agrees with the prosecutor’s opinion when reiterating the legal basis for the appealed resolution. Furthermore, among other aspects, the judge points out that “the preeminent task of the judge in the procedural situation that we contemplate is to rigorously examine the accusations to prevent any citizen from being accused before a court without sufficient grounds for it.” Furthermore, it notes that “none of the accusations have specified” the evidence “individualizing them for each factual episode and for each accused.”
In June 2024, the Court ordered the reopening of the case that had previously been dismissed by the Investigative Court – which found no crime, as did the Prosecutor’s Office – when considering the resources of Vox and Gobierna-te. The judge continued with the procedure due to “legal imperative.”
In June, the investigative body again denied the opening of an oral trial and opted for the provisional dismissal of the case and now reaffirms this decision by rejecting the appeals of the accusations. In this same order, which was notified this Friday to the parties, the appeal filed subsidiarily is admitted for processing.
