Representative Adriana Ventura (Novo-SP) filed a PEC (Proposed Amendment to the Constitution) in the Chamber of Deputies to add to the Magna Carta the provision that the ministers of the (Supreme Federal Court) create a code of ethics for the court.
The text says it mirrors , signed by a group of experts, in favor of a code of conduct and other changes in the court.
She also cites as a reference to members of the United States Supreme Court, in addition to magistrates.
The proposal, filed in November 2025, also proposes the elaboration of a code by the National Council of Justice for members of the judiciary, from higher courts to first instance judges.
“Considering that in the constitutional system it is not up to one power to establish a code of conduct for another, given its essentially internal nature, we are proposing this amendment to the Constitution with the objective of establishing a guideline for the Federal Supreme Court and the National Council of Justice to adopt their respective codes”, says the text.
The PEC proposes that, when creating the code for themselves, STF ministers observe aspects such as “ministers’ obligation to preserve the social perception of impartiality, integrity, honesty and good reputation of the court”, regulation of public demonstrations and participation in events.
It also requests the adoption of rules on the role of ministers in legal proceedings in which there is an interest on the part of a party represented by their spouse, partner or relative, blood or related, in a direct or collateral line, up to the third degree, even if not formally constituted in the case files.
According to the deputy, the measure is necessary for a power that does not have its “legitimacy derived from the popular vote”.
“It is not possible for the country’s highest Court to continue without clear rules on conflict of interests. The STF urgently needs a code of conduct that establishes objective limits and transparency in the relationships of its ministers. Internal resistance only increases distrust in society”, says Ventura.
The PEC proposal, which has not yet reached 171 signatures from federal deputies to begin processing, appears in the wake of other initiatives that ask the Supreme Court for a code of ethics, enhanced by the repercussion of the involvement of ministers and in the case of .
