The president of the Superior Court of Justice (STJ), minister Herman Benjamin, called on judge Luís Carlos Balbino Gambogi, from the Court of Justice of Minas Gerais (TJ-MG), to fill the vacancy opened due to the removal of minister Marco Buzzi, accused of sexual harassment and harassment by two women.

According to a note released by the court, Marco Buzzi’s removal is “precautionary, temporary and exceptional”. Therefore, Gambogi will not occupy the position permanently at this time. The definition will depend on the judgment of the conclusions of the inquiry investigating the allegations, scheduled for March 10th. If Buzzi is permanently removed, the appropriate procedure will be adopted for his permanent replacement.
On the 3rd of this month, Herman Benjamin received a report that Buzzi had committed sexual harassment against an 18-year-old girl. The president of the Court was informed of the case by a group of court ministers.
According to the complaint, the episode occurred during recess, when Buzzi received a family of friends at his beach house, in Balneário Camboriú (SC). The couple’s daughter, who called the minister “uncle”, reported that he had tried to grab her by force. Accompanied by her parents, the young woman filed a police report.
One day after the repercussion of the case, Buzzi presented a medical certificate to the president of the STJ, alleging severe discomfort. He was taken to a hospital in Brasília, where he remained hospitalized until Ash Wednesday, the 18th, when he was discharged.
Less than a week after the first accusation, the National Council of Justice (CNJ) received a complaint from another woman who also claims to have been a victim of sexual harassment by the minister.
Buzzi denies the accusations. After the allegations, he asked to leave his position for 90 days, alleging he had heart problems. The following day, the STJ unanimously decided to temporarily remove him from his duties.
In addition to the investigation at the STJ and the investigation at the CNJ, the case is being processed at the Federal Supreme Court (STF), under the report of Minister Nunes Marques, and is under secrecy.

Judge at TJ-MG, Gambogi graduated in Law from the Pontifical Catholic University of Minas Gerais (PUC-MG) in 1979. He built an academic career in the area of Philosophy of Law: he became a master at the Federal University of Minas Gerais (UFMG) in 1999 and a doctorate from the same institution in 2004.
In addition to working in the judiciary, he also developed a career in teaching. He is a professor of Philosophy of Law at the Faculty of Law of FCH/Universidade Fumec and teaches on the Master’s degree in Law at the same institution.
