Mendonça removes Vorcaro’s obligation to go to the Organized Crime CPI

Testimony is scheduled for this Wednesday (4th March); banker can go to Brasília on a commercial flight or on a PF aircraft

The minister of the (Supreme Federal Court), rapporteur of the case, removed the obligation for the banker to appear before the CPI (Parliamentary Commission of Inquiry) into Organized Crime. The decision, which responds to a request from Vorcaro, was taken and published on Tuesday (March 3, 2026). Here is it (PDF – 159 Kb).

Mendonça decided that, if Vorcaro chooses to appear at the CPI, he has the right to remain silent. If the banker, who is under house arrest in São Paulo, wants to go to the session in Brasília, he must be transported by the (Federal Police) in his own or commercial aircraft, with travel on any private plane being prohibited.

The CPI had approved Vorcaro’s summons last week. The request was authored by the senator (MDB-SE). Here is it (PDF – 443 Kb).

According to the request, the summons was due to investigations investigating Vorcaro’s actions. “in a scheme involving financial institutions and the possible practice of fraudulent management”, “induction or maintenance of investor error”, “use of privileged information and market manipulation” e “money laundering”.

In the request, the senator said that “there is also a possible involvement of criminal factions, given the operations carried out by Banco Master and Reag Trust, (…) also investigated during the Hidden Carbon operation.”.

In the decision, Mendonça stated that, despite the importance “superlative” from the CPI, “the constitutional guarantee of anyone under investigation against self-incrimination is indispensable”.

The minister said that there is jurisprudence from the STF that understands that “the right of an investigated person not to self-incriminate covers the right to attend or not the act”therefore there is no “obligatory or sanction for non-attendance”.

The judge had already taken similar decisions in relation to the former president of the Central Bank and .

On Friday (Feb 27), Mendonça authorized Vorcaro to give face-to-face testimony at the Senate’s CAE (Economic Affairs Committee), scheduled for March 10. According to the president of the commission, the senator (MDB-AL), the person being investigated.

BANCO MASTER

Vorcaro by the PF on November 18, 2025 in the Compliance Zero operation, which investigates alleged billion-dollar fraud in the SFN (National Financial System). The investigation estimates losses of up to R$12 billion.

According to the MPF (Federal Public Ministry), the scheme would involve the issuance of high-yield credit securities, such as CDBs, used to finance funds in which the bank itself appeared as the sole shareholder, which would have artificially inflated the results.

The case is pending in the Supreme Court. The report passed to André Mendonça after the minister on February 12th.
