Reporter criticizes Dino and says that decision could nullify Lulinha’s breach of confidentiality

The INSS CPMI rapporteur, deputy Alfredo Gaspar (União-AL), criticized this Wednesday (4) the annulment of the breach of banking and tax secrecy of businesswoman Roberta Luchsinger by the minister of the Federal Supreme Court (STF) Flávio Dino.

He believes that this decision should open proceedings that could even lead to the annulment of the breach of confidentiality by Fábio Luís da Silva, known as Lulinha, son of President Luiz Inácio Lula da Silva. Luchsinger is Lulinha’s friend.

“The scope of the decision leaves room for doubt. In any case, it is a precedent for everyone”, said the rapporteur.

This is an understanding also shared by the president of the INSS CPMI, senator Carlos Viana (Podemos-MG).

Dino agreed with Roberta’s defense argument and concluded that there was a violation of due constitutional process in the CPMI vote that approved, on February 26, 87 requests jointly – including breaches of confidentiality.

The minister determined that, if the data is already available, it will be kept confidential by the Senate Presidency until the merits of the action are judged by the STF.

In the decision, Dino highlighted that the CPIs have the powers of judicial authorities, but considered that it is necessary to individually justify measures that violate confidential data.

Gaspar stated that the Supreme Court minister “slapped good Brazilians in the face” and “saved Lula from scandals and drowned out transparency in the fight against corruption”. “Dino, you worked against Brazil”, he said.

The rapporteur said he was “revolted and outraged” by the magistrate’s decision. “Lulinha is to blame for the registry office, the banks need to be investigated. You, as a champion of morality, preventing the CPMI from working to clean up this country. We are angry and indignant. We are going to overturn your decision. No one can stand this impunity any longer”, he stated.

Dino entered the field after the president of the Senate, Davi Alcolumbre (União-AP), rejected an appeal from the government base against the vote by the INSS CPMI that approved the breach of confidentiality of Luchsinger, Lulinha and eight dozen other requests.

“This is not a case of flagrant disrespect for the rules of procedure and the Constitution. There is no situation here that justifies the exceptional performance of this presidency to annul the CPMI’s deliberation”, said the president of the Senate in the plenary session.
