OAB asks that confidentiality of the Master case be preserved – 03/12/2026 – Panel

The Federal Council of the OAB sent a letter to the rapporteur of the Master case at the Federal Supreme Court, minister André Mendonça, asking that the confidentiality of communications between lawyers and clients be preserved within the scope of the investigations into the scandal.

The request comes after the publication of messages extracted from material seized from the banker’s cell phone and other sources.

“Although such communications were eventually found in devices or documents belonging to the person being investigated, it is certain that, as they involve direct communication between lawyer and client, they should remain protected by professional secrecy and the confidentiality regime inherent to the exercise of technical defense”, says the letter.

The document is signed by the president of the National OAB, Beto Simonetti, by the national attorney for the Defense of Prerogatives, Alex Sarkis, and by the president of the National Commission for the Defense of Prerogatives and Valorization of Law, Pedro Paulo de Medeiros.

For the OAB, communications of this nature must remain protected by professional secrecy, which is a constitutional guarantee for the exercise of the right to defense and the balance of due legal process.

The entity also requests the excavation (exclusion of the process) of data that violates the prerogatives of the legal profession, investigation of information leaks and guaranteeing the inviolability of communications between lawyers and clients.
