In response to the warning from the Entity for Transparency, Montenegro moved forward with the appeal to the Constitutional Court.
The Entity for Transparency (EpT) threatened to report a possible infraction to the competent authorities if the Prime Minister, Luis Montenegrodo not include the list of customers of the family company Spinumviva in your income declaration again.
According to the report, the warning was made on May 29, 2025. Three days later, on June 2, the head of the Government filed an appeal with the Constitutional Court against the decision of the supervisory entity.
The EpT took this position after rejecting the complaint presented by Montenegro in relation to the decision of April 4, 2025. In this order, the entity determined that the prime minister should declare not only Spinumviva’s customers, but also the services provided to these entities and your bank account balance.
According to this legal framework, EpT can report infractions considered relevant to entities responsible for applying sanctions to political office holders or the Public Prosecutor’s Office, whenever there is evidence that justifies the opening of sanctioning proceedings.
The ruling also states that, on April 4, 2025, the entity sent the prime minister a set of additional requests for clarification. Among the requirements was a detailed declaration of the services provided by Spinumviva to its clients, based on Law No. 52/2019, which regulates the declaratory obligations of public office holders. EpT also requested information about possible heritage assets held by Montenegro indirectly, namely through the family business, taking into account that his wife was his partner.
Spinumviva’s shareholding structure has also come under scrutiny. In March 2025, EpT questioned Montenegro about its participation in the company’s share capital, since there were no changes registered on the Justice Portal. In response, the prime minister stated that he had ceased to be a partner on June 30, 2022, the date on which he sold his share to his wife. The couple later transferred the company to their children.
Spinumviva operates in the area of data protection and maintains monthly retainer contracts with clients, with values ranging between 1000 and 4500 euros. Among the well-known customers is the Joaquim Barros Rodrigues & Filho gas station and the Solverde groupconcessionaire of the Espinho casino, for which Montenegro was a lawyer before assuming office as prime minister.
