Declaration took place during a lecture at OAB-RJ; magistrate is the rapporteur of the STF case regarding Banco Master
Federal Supreme Court (STF) minister André Mendonça stated that a “good judge is not a star”, but someone who fulfills duty responsibly. During a lecture at the Brazilian Bar Association in Rio de Janeiro (OAB-RJ) this Friday (20), the judge said he understood the limitations of judges, but asked judgments with conscience. “As I am a Christian, I ask you to judge in the right way, recognizing that we are not perfect,” he said.
Mendonça also stated that Any errors must be recognized and corrected. “Don’t be afraid to make decisions. If you’re wrong, apologize and correct the course, but don’t stop deciding”, said the minister.
“Courage is the ability, in the midst of adversity, to have the peace of mind to decide. It is not speaking loudly, being arrogant or raising one’s tone. Courage is not irrationality, it is making decisions in a rational, justified and motivated way”, he stated.
Mendonça is the rapporteur of the STF process regarding Banco Masterwhich judges the institution’s financial irregularities and fraud. Banker Daniel Vorcaro is . Last Friday (13), the Second Panel of the STF.
On Wednesday (18), Mendonça met with lawyer José Luís de Oliveira Limawhich acts in defense of Vorcaro. The two talked about the plea bargain agreement that the banker intends to sign. The pact allows reduction in the sentence of the person being investigated in the event of a possible conviction. In return, he needs reveal details about the fraudulent scheme.
Mendonça took over leading the Master’s investigations after the former rapporteur, Minister Dias Toffoli, resigned from the case. Toffoli left his post when he was revealed by the Federal Police connections between the magistrate and his family with Daniel Vorcaro’s business.
The STF investigation investigates the sale of R$ 12.2 billion in fake credit portfolios to BRB and a inflated asset structure that would have artificially increased the Master’s equity. Among those investigated are directors of Master and BRBin addition to businesspeople e former executives linked to financial institutions.
