Senate approves equating misogyny with racism and increases penalties

The Senate approved this Tuesday (24) the (PL 896/2023) which includes misogyny, hatred against women, among the crimes of prejudice or discrimination. In this way, misogyny is equated with the crime of racism.

The project was approved by 67 votes in favor and none against. The voted text was a replacement by rapporteur Soraya Thronicke (Podemos-MS) for the original project by senator Ana Paula Lobato (PSB-MA). Now the text goes to the Chamber of Deputies.

The approved text defines misogyny as “conduct that externalizes hatred or aversion to women”. The project also includes the expression “condition of women” among the criteria for interpreting the Racism Law, alongside color, ethnicity, religion and origin.

Currently, misogyny falls under the crimes of insult and defamation, with a penalty of two months to one year in prison. If the new classification is sanctioned, the penalty will be two to five years in prison, in addition to a fine.

The rapporteur recalled that other countries such as France, Argentina and the United Kingdom already have laws to combat misogyny and that in 2025 seven thousand cases of attempted femicide were recorded in Brazil.

“The project is to protect the family and the dignity and freedom of women. The approval of the project responds to an urgent reality. Hatred against women is not abstract: it is structured, it is growing and it takes lives every day”, said Soraya Thronicke.

The author of the project said that it only asks that women be respected and have the freedom to live their lives. “We do not hate men nor are we against the family. We are in favor of women, who are asking for help”, declared Ana Paula Lobato. “Now, there is a clear response from the Brazilian State. It is the Senate saying that misogyny has consequences”, he added.
