The Porto Court of Appeal acquitted a man who tried to kiss a womanon a café terrace.
The incident took place in August 2023, on the terrace of a cafe in Aldoar, Porto.
The accused got up from the table where he was, approached the table where the woman was (with the company of his cousin and his cousin’s boyfriend), grabbed her head and tried to kiss her on the mouth.
The woman reacted, and so did her cousin’s boyfriend and pushed him away. There was no kiss.
In a first decision, the Bolhão Court sentenced the man to six months in prison, with the sentence suspended for one yearfor crime of attempted sexual coercion.

The Porto Court of Appeal admits that there was “contact of a sexual nature”, but this contact “does not assume sufficient gravity to be considered a major sexual act”.
As it was “a simple harassment”, and the attempted sexual harassment “is not punishable” in the Penal Code, the man was acquitted by the court.
