Class understands that parliamentary immunity protects pronouncement made on International Women’s Day 2023
The 4th Civil Class of the (Court of Justice of the Federal District and Territories) annulled the conviction of the federal deputy (PL-MG) which determined the for collective moral damages for mocking trans women in a speech in the plenary of the Chamber of Deputies, on International Women’s Day 2023.
In a unanimous decision, with a score of 3 to 0, the collegiate overturned the 1st Instance sentence and decided in favor of Nikolas. The lawsuit was filed by the National LGBTI+ Alliance and the Brazilian Association of Homotransaffective Families, which claimed “crime of transphobia, in addition to hate speech and incitement to violence against the LGBTI+ population”.
The judges understood that parliamentary immunity protects the deputy’s conduct, since the demonstrations and gestures took place during the exercise of his mandate and within the premises of the Legislative House.
REMEMBER THE CASE
In the 2023 episode, the deputy wore a , introduced himself as “Deputy Nicole” and criticized agendas related to gender identity.
“Today I feel like a woman, deputy Nikole, and I have something very interesting to talk about. Women are losing their space to men who feel like women”declared the deputy when opening his speech.
The action provoked a strong reaction from civil entities and other deputies, which resulted in the legal action now reversed by the TJDFT.
