The Acre Court confirmed the conviction of a woman accused of improperly using her own grandfather’s money after receiving authorization to manage his bank account. The decision was taken unanimously by (TJAC), which maintained the previously imposed penalties.
According to the process, the elderly man had granted power of attorney to his granddaughter so that she could take care of receiving her retirement and organize her finances. However, investigations showed that part of the amounts deposited, including resources from the pension due to the death of the retiree’s wife, began to be withdrawn without authorization. Upon noticing irregularities in the account, the grandfather sought legal help to recover the money.
The woman even appealed the conviction, stating that there was not enough evidence against her and denying having made any withdrawals or improper movements. The defense also claimed that the amounts had been used to pay medical expenses for the father, who is diagnosed with schizophrenia, and maintained that there was no intention to harm the elderly man.
When analyzing the appeal, the case’s rapporteur, judge Denise Bonfim, concluded that the set of evidence confirms the accused’s responsibility for the irregular withdrawals. For the judge, the fact that the woman took advantage of the family’s trust makes the situation even more serious, since the authorization received should serve to protect, and not harm, the elderly person.
With the decision, the obligation to return R$20,130.83 to the grandfather was maintained, in addition to the provision of services to the community and payment of an 18-day fine. The court’s understanding was published in issue No. 7,984 of the Diário da Justiça, released on Thursday (26).
