Zambelli’s defense files appeal in Italy to avoid extradition

The defense of former federal deputy Carla Zambelli reported this Friday (10) that she filed an appeal to the Italian Court of Cassation to overturn the decision that authorized her extradition to Brazil.

Last month, the Court of Appeal agreed to extradite her, but the decision was not final because it can be appealed.

According to lawyer Fábio Pagnozzi, questions were raised about procedural irregularities, the conditions of the Brazilian prison system and criticism of the actions of Minister Alexandre de Moraes in conducting the process that condemned Zambelli.

“From the beginning, we pointed out flaws in the process, both in the absence of correspondence between the crime of hacking in Italian legislation and in the way the extradition request was formalized,” said the defense.

The Court of Cassation is the last instance of the Italian judiciary. Case analysis can last up to six months.

If the extradition is upheld by the court, the final say on Zambelli’s return to Brazil will be from the Italian Ministry of Justice.

In July last year, Carla Zambelli was arrested in Rome, the capital of Italy, where she was trying to escape the execution of an arrest warrant issued by minister Alexandre de Moraes.

Because she has dual citizenship, Zambelli left Brazil in search of political asylum in Italy after being sentenced by the Federal Supreme Court (STF) to 10 years in prison for the invasion of the electronic system of the National Council of Justice (CNJ), which occurred in 2023.

According to investigations, Zambelli was the mastermind behind the invasion to issue a false arrest warrant against Alexandre de Moraes. According to investigations, the hacking was carried out by Walter Delgatti, who was also convicted and confirmed that he carried out the work at the behest of the parliamentarian.

After fleeing to Italy, the Brazilian government requested the ex-deputy’s extradition to Brazil.
