The election this Saturday (11) to compose the triple list to choose the next Attorney General of Justice has only two candidates: the current occupant of the position, Paulo Sérgio de Oliveira e Costa, 65, and the attorney Marco Antônio Ferreira Lima, 63.
The list of names will be delivered to the governor () for the appointment of the head of the MP-SP (of the State of São Paulo) for the next biennium.
The election will take place electronically and remotely from 9am to 5pm. The expectation is that the result of the election will be announced shortly after the end of the voting process. Around 2,000 prosecutors and attorneys are eligible to vote, according to the institution.
The requirement for a triple list comes from the Organic Law of the São Paulo Public Ministry. Unlike , in which the president can nominate someone from outside the list, the governor is obliged to choose someone from within.
Despite the apparent contradiction of there being only two names in the dispute, the process will indicate which of them received the most votes among the pairs, although Tarcísio has the freedom to choose between them. Oliveira e Costa himself, appointed in 2024, was the one on the occasion.
With almost four decades in the Public Ministry, he has been a prosecutor for Habeas Corpus and Criminal Writs of Mandamus, deputy attorney general of Justice, director of the Escola Superior do MP-SP and director of the São Paulo Public Ministry Association.
The current Attorney General also has a foot in politics. He was Secretary of Social Development for the City of São Paulo in the municipal government of and directed Febem (currently Fundação Casa) in the management of the state.

The only opponent of the current head of the Public Ministry is Criminal Justice prosecutor Marco Antônio de Ferreira Lima. At MP-SP since 1989, he is a former member of the Superior Council of the Public Ministry, from 2022 to 2023. Previously, he served as a prosecutor for the State of São Paulo.
Ferreira Lima is critical of what he calls the financial chaos that the Public Prosecutor’s Office is experiencing, with buildings with broken elevators, “which have no toilet paper” and “a focus of rats and cockroaches”. When talking about pendants, he considers that questions should be asked sparingly.
“For certain situations, the expression penduricalhos is appropriate, for example for those who have education assistance, jacket assistance, for those who have to buy lobster or labeled wine. Now, using the expression penduricalhos for those who are accumulating two, three functions and are not even receiving it is inappropriate. These points need to be corrected.”
