Court rejects Nikolas’ lawsuit against PT councilor – 04/13/2026 – Panel

The Minas Gerais Court rejected the Public Ministry’s complaint based on the representation of the federal deputy (PL-MG) against the Belo Horizonte councilor Pedro Rousseff (PT), for inciting crime in an interview in 2024.

Nikolas stated that Rousseff had encouraged the practice of physical aggression by mentioning that she could “give a few chairs” to opponents.

The decision by judge Gustavo Henrique Hauck Guimarães understood that there were not enough elements to characterize a crime in speech.

“The accused used a figure of speech to describe his own disposition towards political conflict, moving away from the requirement of determining criminal conduct to be followed by others”, he stated.

The judge added that, for the crime of incitement to be considered, it is necessary to encourage the commission of a specific crime, which did not occur. The councilor’s statement was considered generic. The decision may be appealed.

Rousseff, great-nephew of former president Dilma Rousseff, is one of the PT’s bets for the election to the Chamber of Deputies,
