The São Paulo Foundations Association appealed to the governor of , , to veto the project that establishes the charging of a fee for inspection work carried out by the state’s Public Ministry.
The so-called “veiling” of foundations is a responsibility of the body, which now wants reimbursement for the administrative costs arising from the function. The MP claims that the fee will cover the analysis, instruction and conduct of internal procedures, in addition to due diligence, notifications and technical analyses.
The new rate was approved by the Legislative Assembly of São Paulo. The project provides for the payment of R$1,500 for any act of the foundation that requires registration with the MP, in addition to R$3,500 when the entity is to render its accounts, which is done annually.
APF executive manager, Nicole Hoedemaker, says the measure is nonsense and nonsense, especially in an election year.
“The money is for the foundation’s self-sustainability and also for the social purpose for which it was created. And not for an MP fund in which the agents are very well remunerated, by the way,” he said.
The APF, however, questions the charge and says that veiling is the MP’s institutional duty, therefore a mandatory state responsibility.
“Charging fees for acts of veiling the MP, using this assets to finance mandatory and ordinary activities of the State itself, goes against the logic of legal protection of assets that veiling seeks to ensure, in addition to compromising the operational capacity of foundations to fulfill their missions”, he states.
The association complains that the project was approved at the drop of a hat and there was not even time for a hearing with the president of Alesp.
Now, he says he has asked for audiences with the governor or the secretary of , Nerylson Lima da Silva, but has not yet heard back.
